1. Who you are dealing with

2. These terms

These Terms and Conditions govern your use of vanesmari.com (“the Website”) and any purchase you make through it. By using the Website or placing an order, you agree to them. If you do not agree, please do not use the Website.

We may amend these terms from time to time. The version that applies to your order is the version published at the time you placed it.

3. Placing an order

You select the items you want and add them to your basket.
At checkout you provide your delivery details and pay.
You receive an automated email acknowledging your order.

An acknowledgement is not an acceptance. A binding contract of sale comes into existence only when we dispatch your goods and send you a dispatch confirmation.

4. If we cannot fulfil your order

We may decline or cancel an order, in whole or in part, where the item is out of stock, there was a pricing or product description error, we cannot deliver to the address given, we suspect fraud, or payment fails or is reversed.

If we cancel an order you have already paid for, we will refund you in full. We will not be liable to you beyond that refund.

5. Pricing

All prices are in South African Rand (ZAR) and include any applicable tax.
Prices exclude delivery, which is calculated and displayed at checkout before you pay.
We take care with pricing, but errors happen. If an item is listed at an obviously incorrect price, we are not obliged to sell it at that price. We will contact you, and you may confirm at the correct price or cancel for a full refund.
We may change prices at any time, but a change will not affect an order already accepted.

6. Payment

Card payments are processed by Yoco Technologies (Pty) Ltd, a licensed South African payment provider.
We do not receive, see or store your card number, expiry date or CVV.
Your order will not be dispatched until payment has cleared in full.
All transactions take place over an encrypted (SSL/TLS) connection.

7. Delivery

Delivery terms, costs and timeframes are set out in our Shipping and Delivery Policy, which forms part of these terms.

Risk in the goods passes to you on delivery. Ownership passes once payment has been received in full.

8. Returns, refunds and your cooling-off right

Your rights to return goods and receive a refund — including your seven-day cooling-off right under section 44 of ECTA and your rights under the Consumer Protection Act 68 of 2008 — are set out in our Refund and Returns Policy, which forms part of these terms.

Nothing in these terms limits or excludes any right you have under the Consumer Protection Act.

9. Product descriptions and images

We describe our products as accurately as we can. However, colours may appear differently on different screens, product photographs are illustrative, and sizing guidance is indicative.

If an item is materially different from its description, your rights under section 3 of our Refund and Returns Policy apply in full.

10. Availability of the Website

We aim to keep the Website available, but we do not guarantee uninterrupted access. We may suspend, withdraw or restrict access for maintenance or any other reason, without notice.

11. Intellectual property

All content on the Website — including text, photographs, video, graphics, logos, and the name Vanes-Mari du Toit — is owned by us or licensed to us, and is protected by copyright and trade mark law.

You may view and print pages for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute or commercially exploit any part of the Website without our prior written permission.

12. Your account

If you create an account, you are responsible for keeping your password confidential and for all activity under your account. Tell us immediately at info@vanesmari.com if you believe your account has been compromised.

13. Acceptable use

You may not use the Website to do anything unlawful or fraudulent, transmit malware, attempt unauthorised access, scrape or systematically extract data, or post anything defamatory, offensive or infringing.

14. Limitation of liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded — including our obligations under the Consumer Protection Act.

Subject to that, and to the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, or loss of opportunity; and our total liability arising out of any order is limited to the amount you paid for that order.

15. Force majeure

We are not liable for any failure or delay resulting from something beyond our reasonable control — including load-shedding, natural disaster, civil unrest, strike action, courier failure, or the failure of telecommunications or payment networks.

16. Complaints and disputes

If you have a complaint, please contact us first at info@vanesmari.com. We will acknowledge it within 5 working days and do our best to resolve it.

If we cannot resolve it between us, you may refer the matter to:

Referring a dispute to any of these does not affect your right to approach a court.

17. Governing law

These terms are governed by the laws of the Republic of South Africa. The parties consent to the jurisdiction of the South African courts.

18. General

If any provision is found unenforceable, the rest remain in force. Our failure to enforce a term is not a waiver of it. These terms, together with the Privacy Policy, Refund and Returns Policy and Shipping and Delivery Policy, make up the whole agreement between us.
